Terms of Service
Last updated: October 10, 2026. Applies to the Diurnal.ai mobile app (iOS and Android) and the diurnalapp.ai website.
These terms are a contract between you and PUREQUAD SRL, a company registered in Romania, which publishes Diurnal.ai ("we", "us"; company details in section 20). By creating a profile, purchasing a subscription or using Diurnal.ai you agree to them. Our Medical and AI Disclaimer is part of these terms. How we handle personal data is explained in our Privacy Policy, Cookie Policy and Consumer Health Data Privacy Policy; processing of health data is based on the separate consents you give in the app, not on these terms. If you do not agree, please do not use the app. Contact: support@diurnalapp.ai.

1. What Diurnal.ai is, and is not
Diurnal.ai is a lifestyle and wellness organiser. It is not a medical device, not a health care service and not a substitute for a doctor, pharmacist, dietitian or genetic counsellor. Nothing in the app diagnoses, prevents, monitors or treats any disease or condition.
- Everything the app shows (supplement routines and reminders, dose information, seasonal tips, calorie and nutrient estimates, reference daily intakes, weekly reports including inflammation and energy ratings, lab values read from your reports, the list of what lab markers measure, comparisons between two reports, genetic wellness interpretations, cycle predictions, the day by day journal, the health summary for your doctor, trainings (including trainings other users share with you), exercise instructions, workout numbers and personal bests, readiness numbers, training and stretching tips, suggested routes, timing hints for supplements, the caffeine guide, and every answer from Marc, the AI assistant) is general information, not medical advice, diagnosis or treatment.
- Always confirm health decisions (starting, stopping or changing any supplement or medicine, reacting to a lab value, acting on a genetic result, changing your diet) with a qualified professional. Do not stop or change prescribed treatment because of anything in the app; Marc will not tell you to.
- Supplement information stays within commonly used, label-recommended ranges and published upper intake levels. Your own tolerance, conditions, pregnancy, breastfeeding, medicines and age may change what is appropriate for you.
- Emergencies. The app is not for emergencies. If you think you may have a medical emergency, call your local emergency number immediately (112 in Europe, 911 in the United States). If you are thinking about harming yourself, call your emergency number or a crisis line (for example 116 123 in many European countries, 988 in the United States).
2. Eligibility and your account
- You must be at least 18 years old (or the age of majority where you live, if higher) to use the app. The app asks for your year of birth before anything else and cannot be set up for anyone younger. Profiles for other people, including children, are created and managed by you, with the confirmation the app asks for each person (section 6).
- You can use the app with a guest account (tied to your phone), or with an account using your e-mail and a password, Google sign-in or Sign in with Apple. Keep your credentials safe; you are responsible for activity under your account and must tell us promptly about any unauthorised use. One account per e-mail address.
- Keep the information you enter accurate: calorie targets, reference intakes, reminders and Marc's answers are computed from it.
- Some features may be offered only in certain countries or plans; availability can change.
- You must not use the app if you are barred from doing so under the laws of your country or under export control and sanctions laws that apply to us.
3. The AI assistant and AI-generated content
- Marc is an artificial intelligence assistant, not a person. The app tells you this before the first message; by using the chat you acknowledge it. This notice is given in line with article 50 of the EU Artificial Intelligence Act.
- AI features work only after you allow them in the app (AI consent). What is sent to our AI processor, and how it is pseudonymised, is described in the Privacy Policy.
- AI answers, calorie and nutrient estimates from photos and text, identification of foods in photos, lab-report readings and comparisons, supplement-label readings (including brand and ingredient lists), genetic interpretations, weekly reports, workout summaries, coach notes, proposed workouts and routine proposals can be incomplete, inaccurate or wrong. They are provided "as is", for guidance only. Verify anything important, and tell Marc when he could not identify something rather than relying on a guess.
- Reporting an answer. If an answer from Marc is wrong, unsafe or offensive, press and hold it in the chat and choose "Report this answer". The report, including that answer, reaches our team, and we review every report. You can also write to us.
- Marc may propose changes to a routine (adding, changing or removing a supplement, a time or a frequency), may offer to log a meal and may propose a workout. Nothing changes until you accept a proposal (a proposed workout is saved as a training only if you tap to save it); accepting it is your decision and your responsibility, exactly as if you had typed it yourself.
- Marc is limited to wellness topics (supplements, nutrition, hydration, sleep, movement and sport training, lab results, routines and using the app) and to clean, respectful language. He will decline other requests. Attempts to make him produce harmful, deceptive, unlawful or offensive content are a breach of these terms.
- To keep his replies consistent, Marc keeps your conversation threads and a short set of notes about your preferences. You can switch the notes off in Settings ("What Marc can use") or delete everything (Settings → Delete all data).
- Optional: you may connect the chat to your own account with another AI provider using your own API key. That provider's terms and privacy policy then apply to what is exchanged, as described in the Privacy Policy. You are responsible for that key, for keeping it private, and for any costs it incurs with that provider.
- AI-generated content is not reviewed by a health professional before you see it.
4. Health, cycle, lab and genetic information
- Adding lab reports, allergies, body measurements, sleep, cycle data or a raw DNA file is optional. These are sensitive health data. We process them only with the separate, explicit consents you give in the app (health data, AI features, genetic data), which you can withdraw at any time in Settings, as described in the Privacy Policy.
- Lab results are not interpreted. The app shows each value next to the reference range printed on your own report and marks whether it is inside or outside that range; it can list what each marker measures in general, and it can show which values moved between two reports. It never says what a value means for your health, what caused it or what to do about it: that is for your doctor. Reading errors are possible; the original report prevails.
- A lab recheck reminder only reminds you, on the date you chose, to ask your doctor whether a recheck is needed; the app does not decide that.
- Before you upload a photo or PDF of a lab report, cover or crop your name, ID number and address: the whole document is sent to our AI processor to be read.
- Genetic information is informational. A raw DNA file (for example from 23andMe, AncestryDNA or MyHeritage) is filtered on your phone down to a small panel of 42 nutrition-related variants and then deleted. No variant linked to disease risk, medicines or mental health is read. The interpretation is general lifestyle information about food and habits. It is not a genetic test for any disease or a diagnosis, and it does not replace genetic counselling. Photos or PDFs of genetic reports are not read.
- Cycle predictions are estimates. Period, ovulation and fertile window predictions are calendar averages from the period starts you log and your settings; ovulation tests, temperatures and days you mark are kept as a record only. They can be wrong, especially with irregular cycles. They must not be used as a method of contraception or to plan or avoid a pregnancy. Pregnancy week information is general.
- Only submit information about yourself, or about a person you are legally entitled to act for (section 6). Do not upload documents that belong to someone else.
5. Sport, training and routes
Talk to a doctor before you start a new training programme or make your training much harder, especially if you have a heart, lung, joint or other health condition, take medicines, are pregnant, have recently been ill or injured, or have not trained for a long time.
- Stop on warning signs. Stop exercising at once, and get medical help, if you feel chest pain or pressure, unusual shortness of breath, dizziness or faintness, palpitations, or sharp or unusual pain. Stop any exercise that hurts. In an emergency call 112 in Europe or 911 in the United States.
- Not a coach or a medical device. Diurnal.ai is not a personal trainer, coach, physiotherapist or medical device. The exercise library and its figures, trainings, tips, stretching suggestions, readiness numbers, and Marc's proposed workouts, workout summaries and coach notes are general fitness information, not a programme made for you by a professional. Learn the technique of each exercise, warm up, use loads you can control and progress gradually. You decide how and when you train; this does not limit our liability where the law does not allow it (section 13).
- Numbers are estimates. Distance, pace, speed, kilometre splits, climb and the route of an activity come from your phone's GPS and can be wrong, for example near tall buildings, under trees, in tunnels or with a weak signal. Energy (calories), heart rate and heart rate variability (HRV) come from your watch or phone through Apple Health or Health Connect and are approximate. Readiness numbers only compare a value with your own recent average and are not a medical assessment. Personal bests, training load and estimated one-repetition maximums are calculations, not a target to test.
- Suggested routes. Suggested loops (Premium) are calculated automatically by OpenRouteService from OpenStreetMap data, which can be incomplete or out of date. A suggested route may be unsafe, closed, private or not allowed for walking, running or cycling, and may lead through traffic or difficult terrain. Before and during your activity, check the route yourself, follow traffic rules and local signs, and consider traffic, terrain, light, weather and your own fitness. Do not follow a route where it is not safe or not allowed, and keep your attention on your surroundings, not on the screen.
- Recording. A recording continues while the screen is locked until you finish it, and it uses battery. Outdoors, take a charged phone and, when you go alone, tell someone your route.
- Supplement timing and caffeine. Timing hints (for example taking iron away from coffee) and the caffeine guide (based on reference amounts from the European Food Safety Authority) are general information for healthy adults. They do not cover medicines or health conditions and do not replace advice from your doctor or pharmacist.
Sport community: rules, reports and moderation
The Sport community (sport friends, posted workouts and kudos) is optional, free and only for people aged 18 or over. You join by creating a sport profile, after giving the separate consent the app asks for; how your data is used is described in the Privacy Policy. By creating a sport profile you agree to these rules.
- Zero tolerance. We do not tolerate objectionable content or abusive users. You must not use a display name, a training name or an exercise name that is offensive, hateful, discriminatory, sexual, violent or threatening, that harasses or insults anyone, that pretends to be another person, Diurnal.ai or our staff, that advertises anything, or that contains links, contact details or anyone's personal data. You must not use the community to harass, stalk, intimidate or pressure anyone, to send spam, to create fake or duplicate profiles, to collect other users' data, or for anything illegal. Add as friends only people who want to be your sport friends.
- Automatic check. Display names, training names and the names of exercises you share are checked automatically before they are saved; the app asks you to choose other words when a name is refused. The check cannot catch everything, which is why reports matter.
- Report and block. On any profile or post you can tap Report (offensive name, spam or a fake profile, harassment or abuse, or something else), with an optional note, and Block. The person you report is never told who reported them, and under Your reports you see whether your report is being reviewed, led to action or needed no action. Blocking removes the person from your sport friends, removes the requests and kudos between you, stops them from finding you with your code, and they are not told. Anyone, including people without an account, can also tell us about content they believe is illegal by writing to support@diurnalapp.ai: please say where it is (the display name, and the post if there is one), why you think it is illegal, and your name and e-mail address. If your life or someone else's is in danger, call the emergency services (112 in Europe, 911 in the United States) first.
- How we moderate. A person on our team reviews every report, usually within 24 hours, and decides by these rules and the law. We may dismiss the report, delete a post, or hide a profile: a hidden profile disappears for everyone, cannot post and cannot be found by its code, and creating a new profile does not undo it. For serious or repeated breaches we may also suspend or close the account (section 15). When we hide your profile or remove one of your posts, the app tells you what we did, the reason given in the report (for a removed post, also its sport and day) and how to contest the decision; it never says who reported you. When we show a hidden profile again, the app tells you that too. You can also ask us at support@diurnalapp.ai which rule a decision was based on.
- Appeals. If you think we made a wrong decision about your profile, your post or your report, write to support@diurnalapp.ai within 6 months. A person reviews it again, where possible a different one, and we tell you the outcome; if we were wrong, we restore what we can (a hidden profile is shown again; a deleted post cannot be brought back, but you can post the workout again). You can also use the dispute routes in section 16, and the courts.
- No messages, no notifications. The community has no messages, comments, free-text posts or photos, and sends no push notifications.
- Leaving. You can delete a post, remove or block a friend, or delete your sport profile at any time; deleting it erases your profile, posts, kudos, sport friends and shared trainings from our server.
Shared trainings
- You can share a training as text, with a code that works for 30 days, or on your sport profile. Anyone who has the code can see the training and save a copy; it never shows your name. Share only trainings you are entitled to share, and give them names that follow the rules above.
- A training someone shares with you is their content, not ours. We do not check it, and it is not professional advice or a programme made for you. Before you use it, check that the exercises, the number of sets and reps, the rest and above all the weights suit you, and follow the safety advice at the top of this section. A copy you save is yours to change or delete; the person who shared it cannot change your copy.
6. Family members and people you care for
- You may add profiles for people who do not use the app themselves (a child, a parent, a partner) and manage their supplement routine, reminders, allergies and food preferences.
- You confirm that you are entitled to enter that information: you are the parent or legal guardian of a child, or you have the person's permission. You remain responsible for anything you enter and for any supplement you give them.
- For these profiles Marc only helps with their routine, receives them only as relation and age range (never their name), and never uses your own lab, genetic, meal or sleep data. Nutrition tracking, lab or genetic features for that person require their own account.
- Be especially careful with children, pregnant or breastfeeding people and the elderly: keep to label-recommended doses and confirm with their doctor or pharmacist.
- Friend and family features let you exchange requests with other users by e-mail; use them only with people who want to hear from you.
7. Subscriptions, payments, withdrawal and refunds
- The free plan includes limited AI allowances, shown in the app and on our website (for example 10 messages with Marc and 1 AI meal per week). Until your e-mail address is confirmed or the app is verified on your phone, a smaller starter allowance applies. Premium unlocks higher allowances, which are still limited for fair use, and the premium features shown in the app.
- Premium is sold as an auto-renewing subscription purchased through Apple's App Store or Google Play (monthly, yearly, or a Family plan). The final price in your currency, including VAT or sales tax, is shown by the store before you confirm; prices on our website are indicative.
- Payment is charged to your store account when you confirm the purchase. The subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it at any time in your App Store or Google Play subscription settings; cancelling stops future renewals and Premium stays active until the end of the period already paid. A free trial, where offered, converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. An introductory price (for example a launch offer), where offered, is for new subscribers and covers only the first billing period shown by the store (for example the first month, or the first year of a yearly plan); the subscription then renews at the regular price unless you cancel at least 24 hours before that period ends. The store allows one introductory offer per person. Deleting the app or your account does not cancel a store subscription.
- Family plan. The person who buys the Family plan (the owner) chooses its size, from 2 to 6 people including the owner, and can invite up to 5 other people with single-use codes, as many as the size allows. The owner can move to a larger or smaller size in the store; a smaller size applies from the next renewal, and if more people have joined than the new size covers, the members who joined last lose Premium until there is room again. Each member uses their own Diurnal.ai account and keeps their own data. The owner sees each member's name and a shortened e-mail address and can remove a member; members see the owner's name and can leave at any time. A member has Premium while the owner's Family subscription is active; it ends when the subscription ends, the owner removes them or they leave. The owner should invite only people who agree to join.
- Right of withdrawal (consumers in the EU, EEA and UK). Premium is a digital service. You may withdraw from a subscription purchase within 14 days of buying it, without giving a reason. Premium starts as soon as you buy it because you ask for that when you confirm the purchase; if you withdraw within the 14 days, you pay only for the days of Premium already provided, and the rest is refunded. Payment goes through Apple or Google, which sell the subscription to you, so withdrawals and refunds are made through the store (Apple: reportaproblem.apple.com; Google Play: your order history or Google Play's refund request page). You can also tell us by e-mail ("I withdraw from my Diurnal.ai subscription", with the e-mail of your account) and we will help you complete it with the store. Your statutory rights for digital content or services that are not in conformity (Directive (EU) 2019/770) are not affected.
- Other refunds are handled by Apple or Google under their policies; we cannot issue store refunds ourselves.
- We may change prices or what Premium includes; changes apply from the next renewal, and the store notifies you in advance where required, with the option to cancel. If we materially reduce what Premium includes during a period you have already paid for, or stop the service, you may end the subscription and we will refund the unused part of that period, through the store where we can, otherwise directly. Promotional codes and gifted or granted subscriptions follow the conditions shown when they are offered, are personal, non-transferable and have no cash value.
- We do not receive or store your card or bank details. Subscription status is managed with RevenueCat (see the Privacy Policy). Payment errors and store outages are resolved by the store.
8. Acceptable use
You agree not to:
- access or try to access other users' data, our servers or databases other than through the app;
- overload, probe, scrape, decompile, reverse-engineer or interfere with the service, or bypass usage allowances, rate limits, the app integrity check or the safety rules applied to the AI assistant;
- misuse the AI assistant to generate harmful, misleading, discriminatory, sexual, hateful or unlawful content, to obtain medical prescriptions, or to harass anyone;
- submit other people's health data or documents without the right to do so, or impersonate anyone;
- use friend requests, family invitations or the newsletter for spam or unsolicited marketing;
- break the Sport community rules (section 5), for example with offensive names, harassment or fake profiles;
- upload malware, or use the service to build a competing product by systematically extracting its content;
- resell, rent or share your account or subscription, or use the service commercially without our written permission.
We may limit, suspend or terminate accounts that break these rules (section 15).
9. Your content and our rights
- Your data remains yours. You grant us only the worldwide, non-exclusive licence needed to run the service for you: to store, sync, back up, display and process it as described in the Privacy Policy and allowed by your consents, including sending it to our AI processor for the features you use. The licence ends when you delete the data, except for copies in server backups, which are overwritten within 30 days.
- When you use the Sport community or share a training, you also grant us the licence to show your sport profile, the workouts you post and the trainings you share to the people you share them with (your sport friends, or whoever enters your training code), and to let them save a copy of a shared training. This licence ends when you delete that content, your sport profile or the code, except for copies other people already saved of a training you shared.
- You are responsible for the content you submit and confirm you have the right to submit it.
- Help improve Diurnal.ai (optional). If you turn on this switch in Settings, Health data consent, the workouts you record in the app and a few profile ranges are used, only in statistics about groups of at least 5 people, to improve workouts, exercises and suggestions, as described in the Privacy Policy. It is off unless you turn it on, you can turn it off at any time, and saying no changes nothing in the service or its price.
- If you send us feedback or ideas, we may use them without obligation to you.
- The Diurnal.ai app, website, brand, design, texts, illustrations, the Marc character and the underlying software are the intellectual property of PUREQUAD SRL or its licensors, protected by copyright, trade mark and other laws. We grant you a personal, non-transferable, revocable licence to use the app on devices you own or control, in line with these terms and the store's usage rules. You may not copy, modify, distribute, sell, sublicense or create derivative works from them, or remove any notices.
- Third-party open-source components in the app are licensed under their own terms, listed in the app or on request.
10. Third-party services
The app relies on services we do not control: Apple and Google (stores, sign-in, payments, Apple Health and Health Connect, Siri and Google Assistant), OpenAI (AI processing), RevenueCat (subscriptions), Brevo (e-mail), Hetzner (hosting), OpenRouteService by HeiGIT with data from OpenStreetMap (suggested loops), and any AI provider you connect yourself with your own key. Route maps use Apple Maps on iPhone. On Android, where the app shows Google Maps, that feature is provided by Google and your use of it is subject to the Google Maps Additional Terms of Service and the Google Privacy Policy. Their availability, accuracy and terms are theirs; we are not responsible for their acts or omissions beyond what the law requires of us as their customer. Links to other websites are provided for convenience and do not imply endorsement.
11. Availability, updates and changes
We work to keep the app available but do not guarantee uninterrupted or error-free operation; AI features depend on third-party providers and may be temporarily unavailable, slower, or limited by allowances. We may add, change or remove features, update the app (updates may be needed to keep using it) and set or change usage allowances. If a change materially reduces what a paid subscription includes, you can cancel it and get a refund of the unused part as described in section 7, and we will tell you in advance. We may also stop the service altogether with reasonable notice, in which case you can export your data first and unused prepaid periods are refunded.
12. Warranties
If you are a consumer in the European Union, the United Kingdom or another country with mandatory consumer protection, you have statutory rights concerning the conformity of digital content and services, and nothing in these terms limits them. To the extent permitted by the law that applies to you (in particular for users in the United States), the app and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not warrant that AI output, estimates, readings, predictions or reports are accurate, complete or fit for any health purpose.
13. Liability
- We are liable without limitation for damage caused by our intent or gross negligence, for death or personal injury caused by our negligence, for fraud, under mandatory product liability law, and in any other case where liability cannot be limited by the law that applies to you.
- Otherwise, to the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages or loss of profits, and our total liability to you for all claims arising from the service in any 12-month period is limited to the greater of the amount you paid for the service in those 12 months and EUR 50. This limit never applies to harm to your life, body or health caused by our fault, which the law does not allow us to exclude (for Romania, article 1355 of the Civil Code).
- The app's content, including AI answers, is general information (section 1). Please check anything that matters for your health with a professional before acting on it; this does not reduce our liability where the law does not allow it to be reduced.
- We are not liable for the acts of third-party providers, for content you or other users submit, or for events beyond our reasonable control.
- Nothing in these terms limits your statutory consumer rights.
14. Indemnity
This section does not apply to you if you use the app as a consumer (for purposes outside your trade or profession), which is how the app is meant to be used. If you use it for business purposes, you will compensate us for losses, costs and reasonable legal fees arising from your breach of these terms, your unlawful use of the service, or content you submit without the right to do so (including another person's health data).
15. Termination
You can stop using the app and delete your data at any time (Settings → Delete account and all data, which also deletes your account on our server; see Delete your account). Remember to cancel any store subscription separately. We may suspend or close accounts that breach these terms, after notice and a chance to respond where reasonable, and immediately where necessary to protect other users or the service. In the Sport community we may also hide a profile or delete a post without closing the account (section 5). If we close your account for a reason other than your breach, we will refund any prepaid, unused subscription period through the store where we can. Sections that by their nature should survive (liability, intellectual property, governing law) survive termination.
16. Governing law and disputes
- These terms are governed by the laws of Romania and applicable European Union law.
- If you are a consumer, this choice of law does not take away the protection of the mandatory consumer rules of the country where you live: those rules continue to apply. You may bring a claim in the courts of the country where you live or in Romania, and we can bring a claim against you only in the courts of the country where you live.
- Consumers can also contact their national consumer protection authority; in Romania this is the ANPC (Autoritatea Nationala pentru Protectia Consumatorilor, anpc.ro), which also provides alternative dispute resolution. Consumers in other EU countries can get free help from the European Consumer Centres network. We are not obliged to take part in alternative dispute resolution but will consider it in good faith.
- Users in the United States keep the protections of their state's consumer laws. These terms contain no mandatory arbitration and no class-action waiver.
- Before starting a claim, please write to us; we commit to try to resolve the matter within 30 days.
17. App Store and Google Play terms
These additional terms apply when you download the app from Apple's App Store or Google Play.
- These terms are between you and PUREQUAD SRL only, not with Apple Inc. or Google LLC. Apple and Google are not responsible for the app or its content and have no obligation to provide maintenance or support for it.
- The licence is limited to use on Apple-branded or Android devices that you own or control, as permitted by the App Store Terms of Service or the Google Play Terms of Service, including their family sharing rules.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple or Google, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, claims under consumer protection or privacy laws, and claims that the app infringes a third party's intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (for example your mobile data plan) when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
18. General
- These terms, with the documents they refer to, are the entire agreement between you and us about the service.
- If a provision is found invalid, the rest remains in force and the provision is replaced by a valid one closest to its intent.
- Our not enforcing a provision is not a waiver of it.
- We may transfer these terms to a successor of our business; we will tell you, and you may terminate if you do not agree. You may not transfer them.
- Notices to you are given in the app or by e-mail to your account address; notices to us go to the contact below.
- Point of contact under the EU Digital Services Act (articles 11 and 12), for authorities and for users: support@diurnalapp.ai, in English or Romanian.
- The app is offered in several languages; these terms are written in English and govern in case of doubt, unless the law of your country requires otherwise.
19. Changes to these terms
We may update these terms. Material changes will be announced in the app (and by e-mail where you have an account) at least 30 days before they take effect, and the latest version always lives at this address. For a material change the app asks you to accept the new terms; if you do not accept, you can export your data and delete your account, and unused prepaid periods are refunded as described in section 7. Minor changes (for example wording, contact details or new features that take nothing away) apply when published.
